BillYourTime is a trade name of Peachtree ESQ, Inc., a Georgia corporation. Any mention of BillYourTime on this website or in any communications with you is synonymous with Peachtree ESQ, Inc.
1. Acceptance of Terms
Welcome to BillYourTime, your trusted time management solution. These Terms and Conditions ("Terms") govern your use of the BillYourTime services and website. By using BillYourTime, you agree to comply with and be bound by these Terms.
2. Use of Services
2.1 Eligibility: You must be at least 18 years old to use BillYourTime. By using our services, you confirm that you meet this age requirement.

5.1 Termination by You: You can cancel your account at any time by following the cancellation process outlined in our Refund & Cancellation Policy.
5.2 Termination by BillYourTime: We reserve the right to terminate or suspend your account for any reason.

7. Limitation of Liability
To the extent permitted by law, BillYourTime shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

The revised Terms will be effective immediately upon posting on your website or upon publication to you via email. Your continued use of BillYourTime after any changes constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia (United States), without regard to its conflict of law principles. Any dispute regarding the use of BillYourTime shall take place within the State of Georgia and all parties agree to submit to the jurisdiction of said state.
10. Use of Artificial Intelligence ("AI") Feature
The AI feature on this site is enabled by OpenAI's ChatGPT. The performance of the AI feature can vary, and it may generate inconsistent results and inaccuracies. It is your responsibility to review the text generated by AI to ensure its accuracy and suitability. Furthermore, as the AI feature is powered by OpenAI's ChatGPT, you are bound by the terms, conditions, and disclaimers established by that company. Additionally, it's important to familiarize yourself with ChatGPT's privacy disclaimers and data usage policies, as they may influence your decision on when and whether to utilize the AI feature offered by BillYourTime.
11. Mandatory Arbitration Clause
All disputes arising in connection with the present agreement to use BillYourTime shall be settled by arbitration. Any arbitration must be held within the State of Georgia unless the parties agree otherwise in writing.
Any arbitration between the parties to this agreement will be conducted pursuant to the rules of the arbitration institution chosen by BillYourTime, its heirs, successors, or assigns, unless the parties agree otherwise in writing.
Arbitrators must be members of the State Bar of Georgia actively engaged in the practice of law with expertise in the process of deciding disputes and interpreting contracts regarding software usage.
Any provisional remedy which would be available from a court of law shall be available from the arbitrator to the parties to this agreement pending arbitration and either party may make an application to the arbitrator seeking injunctive relief to maintain the status quo until such time as the arbitration award is rendered or the controversy is otherwise resolved.
The arbitrators will have no authority to award punitive damages or any other damages not measured by the prevailing party's actual damages, and may not, in any event, make any ruling, finding or award that does not conform to the terms and conditions of the agreement.
The arbitrator shall have the discretion to order a prehearing exchange of information by the parties, including, without limitation, production of requested documents, exchange of summaries of testimony of proposed witnesses, and examination by deposition of parties.
The arbitration award shall be in writing and shall specify the factual and legal bases for the award.
All fees and expenses of the arbitration shall be borne by the parties equally. However, each party shall bear the expense of its own counsel, experts, witnesses, and preparation and presentation of proof.
12. Integration clause
All matters within the scope of bargaining have been negotiated and agreed upon. The terms and conditions set forth in this agreement represent the full and complete understanding and commitment between the user of BillYourTime and the owners of BillYourTime.
